Terms & Conditions

By consenting to receive our services you agree to be bound by our terms and conditions set out below. We reserve the right to change, update or reissue these Terms and Conditions at any time. Any changes will be posted to our website and you agree to be bound by such changes.


Payments

  • Payments must be made upon booking. To book into a class, you must have pre-purchased classes.
  • Payments can be made via bank transfer, via the Mindbody app or in person at our clinic.
  • Our current prices are displayed on our website. Our prices may change from time to time which will be posted on our website.
  • Classes are non-claimable with your private health insurance as per the new government regulations from 1st April 2019.


Bookings

  • Bookings can be made online via the Mindbody app or over the phone.
  • Classes are limited in size. To attend a class, you must reserve a spot.
  • If you are unable to book a spot because the class is full, you can register yourself on the waitlist. When a spot becomes available, you will be notified via email or text. Please ensure you check your email for your waitlist confirmation. Your are under no obligation to take a waitlist offer however, as courtesy for our instructors and other clients, if your are no longer available to attend the class, please remove yourself from the waitlist via the Mindbody app or contact us.
  • Once your have been confirmed into the class from the waitlist, our 24 hour courtesy policy applies and a cancellation fee will apply if cancelled within this timeframe.
  • Bookings on casual basis are also an option.


Cancellations

  • To cancel an appointment you must notify our clinic at least 24 hours prior to the commencement of your appointment.
  • We do understand that sometimes unforeseeable circumstances can arise, but we need to be fair with all clients.
  • If you make a booking and fail to attend then the full class fee will be charged.
  • If less than 24 hours notice is given, the following fees apply:
    • Pilates Consultations: 100% of the fee will be charged. This also applied if you fail to attend your class
    • Chiropractic Consultations: $50 cancellation fee will apply and will be charged on your next visit to the clinic
    • Other services provided at Form Fit: $50 cancellation fee will apply.
  • This relates to all clients irrespective of their method of funding.
  • Out of consideration for your instructor/practitioner and other clients, if you cancel your appointment three times over a period of four weeks, regardless of whether you gibe 24 hours notice, you will automatically forfeit your spot in your permanent class.
  • All appointments including Pilates, Chiropractic, Massage, Podiatry, Clinical EFT can be cancelled or rescheduled online via the Mindbody app or by contacting the clinic.


Late arrival to your appointment

  • If you arrive late to an appointment, but within your appointed time frame, you may receive a shorter consultation as determined by your practitioner in order to not inconvenience other clients.
  • If you either arrive after or do not show up to your appointment, you will be charged the full consultation fee for pilates or $50 fee for all other services provided at Form Fit.
  • Full payment must be made within 1 week of late or missed appointment otherwise an administration fee of $30 will be charged.


Pilates Packs

  • All packs must be pre-pain before attendance.
  • The sale of each pack is subject to a strict expiry date applicable to the type of pack you have purchased. If the holder has not used the number of classes for which the class pack entitles attendance before the expiry date, then those classes will expire and no refund will be given for any unused classes.
  • Remaining credit cannot be redeemed in products or other services. Form Fit does not offer any refunds, transfers, suspension or extensions on class packs for illness, injury, change of mind or user error, change of address, unsuitability or any other reason.
  • Current prices and expiry time frames for each type of class pack can be found on our website and may be amended from time to time.
  • Our packs are non-transferrable to another person, cannot be sold, traded, gifted or shared to any person other than the purchaser.
  • Packs can be extended if you are injured in which case we will request a medical certificate. Extensions due to medical reasons must be requested before the expiry date of your pack.
  • We reserve the right, in our discretion to suspend or terminate your use of any class packs if we suspect any fraud or misuse of our online booking system.


Gift Vouchers 

  • Any gift vouchers purchased from Form Fit are limited to the current dollar value held on the voucher and are not redeemable for cash.
  • Form Fit is not responsible for loss or theft of gift vouchers.
  • All gift vouchers have a strict expiry date and unredeemed balances on the gift voucher are not refundable.
  • Gift vouchers may not be returned or resold.
  • Form Fit does not offer refunds, transfers, suspensions or extensions on the gift vouchers for change of mind, injury, illness, change of address or any other reason.
  • All purchases are final and in accordance with the ACCC.


Class Schedule 

  • Class schedules may differ from week to week and are subject to change or cancellations without notice.
  • A minimum of two people is required for a class to proceed. You will be contacted via text 2 hours prior to the start of your class should it need to be cancelled.
  • We reserve the right to change our opening hours at out clinic without notice to you. You will not be notified of any permanent changes to our opening hours.


Conditions of Entry

  • We reserve the right to to refuse entry to clients or others who are behaving in an aggressive, offensive or dangerous manner, which may threaten the security of our staff and clients.


Acceptance of risk and personal safety

  • By attending our clinic and participating in our classes, you will be performing physical activity and exercises, which has an inherent risk of personal injury. Therefore, participating in Pilates is undertaken at your own risk.
  • You must inform instructors if there are any risks to your health by participating in Pilates, if you have a pre-existing injury, illness, and muscle soreness/discomfort or are pregnant, prior to commencement. Participating in any form of exercise at our clinic with a Medical Condition is done entirely at your own risk.
  • Some of our Pilates instructors are not qualified to assess whether clients are in good physical condition and/or that clients can engage in exercise without detriment to their health, safety, comfort or physical condition.
  • We recommend that you seek medical advice prior to commencing any exercise program.
  • In relation to recreational services (as that term is defined in section 139A of the Competition and Consumer Act 2010 (Cth)) for any death, physical or mental injury (including aggravation, acceleration or recurrence of any such injury), the contraction, aggravation or acceleration of a disease, the coming into existence, aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs that is or may be harmful or disadvantageous to you or the community, or that may result in harm or disadvantage to you or the community, that may be suffered by you as a result of the supply of recreational services by Form Fit and Function Health is hereby excluded, save that this limitation of liability does not apply to significant personal injury suffered by you as a result of reckless conduct by Form Fit and Function Health in supplying the recreational services.
  • You acknowledge that our instructors may use tactile cueing and adjustment methods, or make physical contact with you for correction purposes in order to ensure that Pilates practice is undertaken in accordance with Form Fit best practice


Security

  • Form Fit is not responsible in any way for the safekeeping of your personal belongings that you bring into our clinic. As such, we strongly recommend that you avoid bringing any valuable personal belongings into our clinic.


Consent to Treatment

  • Upon giving consent you agree to allow our practitioner to collect personal and clinical information and to perform all necessary examinations, manipulations, adjustments, soft tissue therapy, dry needling, taping, nutritional advice and rehabilitation (including Pilates) or any other treatment modalities in accordance with their professional training and understanding of your injury.
  • You have the opportunity to discuss with your practitioner the nature and purpose of your care before you undergo any type of treatment.
  • You acknowledge and accept:
    • Physical nature of our services and treatments and the possible adverse risks associated with them. The possible risks may include but are not limited to:
    • Aggravation of an existing condition or injury
    • Stiffness and soreness
    • Soft tissue injury which may include bruising
    • Sleepiness and/or light headedness
    • Fainting
    • Fracture
    • Sprain and/or strain to ligaments, joint capsules, muscles or tendons
    • Spinal cord trauma
    • Rupture of disc
    • Infection
    • Pregnancy related complications
    • Neurological complications
    • Cerebrovascular injuries
    • Skin irritations, burns and other minor complications

If you have experienced these symptoms or aggravations in the past you MUST inform your practitioner.

If you do consent to our treatment, other options exist including consulting your general practitioner.


Consent to obtain and release information

  • To assist with the management of your injury or claim, you understand and accept that it may be necessary to share your personal information and details of your medical condition with our employees, your employer, contractors, colleagues, medical practitioners, allied health professionals, case managers and other parties reasonably expected to be included in the treatment of your case.


Accounts and billing

  • Please see our most recent fee schedule for our services or alternatively contact the clinic for further information.
  • It is a requirement that all fees are paid in full at the time of consultation. Payment options accepted include cash, EFTPOS, credit cards (excluding AMEX) and we offer electronic health rebates via HICAPS. In the event that our EFTPOS or HICAPS system is unavailable, full payment is still required via cash or direct bank transfer.
  • Our strict billing methods aim to provide equality to all our clients. However, we will not deny our services to anyone. If you are experiencing any financial hardship, please contact us directly to discuss your options.


Privacy Policy

  • Form Fit and Function Health has a Privacy Policy Statement and operates in accordance with the Code of Conduct for Chiropractors as issued by the Chiropractic Board of Australia.
  • If you do not agree with any of these terms and conditions, please do not consent to our services.
  • We reserve the right to change, update or reissue these terms and conditions at any time.
